CONSUMER LAW


 

Consumers are often unaware that the law is designed to protect their rights and safety. In fact, since Ireland joined the European Union, stricter standards have been imposed upon companies to the benefit of consumers.

 

Often items purchased turn out to be either defective or of poor quality in some way. This defect or lack of quality could possibly result in danger to the user, as in the case of electrical or mechanical goods. It is also important to note that purchasers of second-hand goods enjoy a certain amount of legal protection.

 

Most providers of services are subject to similar legislation to that of goods suppliers. For example, a service carried out on a good (e.g. cleaning) in an incorrect or poor quality manner can result in a right of action aginst the service provider. Consumer protection lawis often broader than the public are aware and extends to financial institutions and the provisions of loans, mortgages etc.

It is extremely useful, before seeking legal advice, if you have located all receipts or other proofs of purchase. If you return an item to the manufacturer or retailer, you are entitled to proof of their receipt of an item. You can always approach the shop or company directly to try and solve the issue. However, the best course of action is to take legal advice from your solicitor as soon as possible.
